Temporary restraining order (TRO) and injunctive relief are solutions when the time is of the essence, where Court intervention is necessary to prevent irreparable harm, such as often happens in strained business relations when funds or trade secrets are on the line, or class actions when the public interest is at stake. TRO and injunctive relief are ways to prevent the harm that will continue for the duration of the litigation process.
Our firm used injunctive relief with great success on behalf of the families affected by the now infamous scandal at Burr Oak Cemetery. A class action lawsuit was filed on July 10, 2009, when it was revealed that cemetery employees removed deceased bodies from grave-sites, damaging and destroying the remains. Through injunctive relief, Blake Horwitz convinced the Court that swift action was needed to prevent further abuses. The Court removed the cemetery owners and appointed a “receiver” to oversee the cemetery, while the State investigated Cemetery employees for criminal misconduct.
